Your data is protected within the framework of legal regulations. Below you will find information on the collection of personal data on this website, available on the Internet at http://shop.gibsonpowertech.com/datenschutzerklärung (hereinafter also referred to as the website).

1.2.1 Legal bases

The processing of the personal data of our users is carried out with your consent or on the basis of a legal permission.

Insofar as we obtain consent for the processing of personal data, art. 6 para. 1 lit. a) EU General Data Protection Regulation (GDPR) is the legal basis for the processing.

The legal basis for the processing of personal data required for the performance of a contract to which the data subject is a party is art. 6 para. 1 lit. b) GDPR. This also applies to processing operations that are necessary for carrying out pre-contractual measures.

Insofar as the processing of personal data is necessary to fulfil a legal obligation incumbent on us, the legal basis is art. 6 para. 1 lit. c) GDPR.

In the event that the vital interests of the data subject or another natural person require the processing of personal data, art. 6 1 lit. d) GDPR serves as the legal basis.

If processing is necessary to safeguard a legitimate interest of our company or a third party and if the interests, fundamental rights and freedoms of the data subject do not outweigh this interest, art. 6 para. 1 lit. f) GDPR is the legal basis for the processing.

Regardless of the possible withdrawal of your consent, we process and store your personal data for as long and as far as it is necessary for the fulfilment of the respective purposes.

If your data is no longer required for the aforementioned purposes, it will be regularly deleted. This is done while taking into account existing statutory retention periods and obligations under the German Commercial Code, etc.

1.2.3 Recipients or categories of recipients

If necessary for the provision of the website or the processing activities described in section 2, we transmit your data to payment service providers, logistics partners, postal service providers and IT service providers.

In this case you have the right of access (art. 15 GDPR), the right to correction (art. 16 GDPR) and deletion (art. 17 GDPR) of your data, the right to limitation of the processing (art. 18 GDPR), a right of objection to the processing (art. 21 GDPR) and the right to data transferability (art. 20 GDPR). You also have the right of appeal to a supervisory authority pursuant to art. 77 GDPR.

In the case of automated decision-making (including profiling), you also have the right to express your point of view on automated decision-making and to have this decision checked manually by us for accuracy.

1.4 Revocation of declarations of consent

If you have given us your consent to process your personal data, you can revoke this at any time – including by e-mail: sales@gibsonpowertech.com.

3. COOKIES

3.1 What are cookies

We use cookies and other web technologies on our website to make your visit attractive and to enable the use of certain functions. Many useful functions of our website cannot be implemented without the use of cookies.

A cookie is a small file that stores Internet settings. It is loaded from the Internet browser the first time you visit a website. The next time you visit this website, the cookie and the information stored therein will either be transmitted to the website that generated it (first party cookie) or to another website to which it belongs (third party cookie). In this way, the website recognizes that you have already visited with this browser. Other web technologies are used for similar purposes, so that in this context we also refer to these technologies as "cookies".

Most of the cookies we use are deleted from your hard disk at the end of the browser session (so-called session cookies). Other cookies remain on your computer and enable us to recognize your computer on your next visit (so-called permanent cookies).

Depending on their function and intended use, cookies can be divided into four categories: operationally-necessary cookies, performance cookies, functional cookies or cookies for marketing purposes:

Operationally-necessary cookies are required so that you can navigate and use the basic functions of our website, such as the assignment of anonymous session IDs.

Performance cookies are used to improve the user-friendliness of a website. They collect information about the use of our website, e.g. information about the Internet browser and the operating system; the domain name of the website from which you came, number of visits, average length of stay, and pages accessed. However, these cookies do not store any information that would allow personal identification of the user.

Functional cookies enable a website to store information already provided (such as user name, language selection or your location) and to offer the user improved and more personalized functions. Functional cookies are also used to enable requested functions such as video playback.

Cookies for marketing purposes are used to offer relevant, adapted content to the user. They are also used to limit the frequency of an ad and to measure and control the effectiveness of advertising campaigns. They register whether or not you have visited a website and what content has been used. This information may be shared with third parties, e.g. advertising partners.

3.2 Managing cookies in the browser

Most Internet browsers allow you to manage the use of cookies, e.g. to accept or reject all cookies or to accept only certain cookies. You can also set your browser to inform you when cookies are placed. This makes the use of cookies transparent for you. You will find the options for managing and deleting cookies in the documentation integrated in the respective browser.

If cookies are deactivated for our website, it may no longer be possible to use all the functions of the website in full. Please note that ordering from the shop is only possible with activated cookies.

3.3 Consent and revocation

If you do not deactivate cookies in your browser and use our website, you agree to the use of cookies for the marketing purposes described here. You can revoke this consent at any time with effect for the future – for example, by refusing to accept cookies in your browser settings.

The legal basis is art. 6 para. 1 lit. a) GDPR.

3.4 Use of cookies

3.4.1 Operation of the website

In order to make your visit to our website attractive and to enable the use of certain functions, we use so-called cookies on various pages. These are small text files that are stored on your mobile device. Some of the cookies we use are deleted after the end of the browser session, i.e. after closing your browser (so-called session cookies). Other cookies remain on your terminal and enable us to recognize your browser on your next visit (persistent cookies). You can set your browser in such a way that you are informed about the setting of cookies and decide individually about their acceptance or exclude the acceptance of cookies for certain cases or generally. If cookies are not accepted, the functionality of our website may be limited. IMPORTANT: This website only stores IDs in the customer's browser; assignment to the respective information takes place in the application area.

Based on the session cookie, the website decides whether the respective user has an active shopping basket and whether the user is logged in. It therefore serves as identification between the browser and server. No further information apart from the session ID is stored in the browser. The handling of sessions is controlled by PHP on the server side and should be considered independently of this website.

Your consent is not required for the use of such cookies. The legal basis is art. 6 para. 1. lit f) GDPR. The legitimate interest lies in providing the corresponding functions of our website.

3.4.2 Google Analytics

For website analysis we use the technology of Google Analytics, a service of Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google").

Google Analytics uses "cookies", which are text files that are stored on your computer and which enable the website to analyse how you use the website. This data can be used to create pseudonymous user profiles. The information generated by the cookie about your use of this website is usually transferred to a Google server in the USA and stored there. However, Google will within member states of the European Union or in other states party to the Agreement on the European Economic Area shorten the IP address in advance. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. The IP address transmitted by your browser in the context of Google Analytics is not merged with other Google data.

Google (Universal) Analytics is a service of Google LLC (www.google.co.uk). Google LLC is based in the USA. The European Commission has issued an adequacy decision for this state, the EU-US Privacy Shield, according to which Google LLC is certified. A current certificate is available here:

https://www.privacyshield.gov/list.

You may refuse the use of cookies by selecting the appropriate settings on your browser. You can also prevent Google Analytics from using your data by downloading and installing browser add-ons to disable Google Analytics:

https://tools.google.com/dlpage/gaoptout.

As an alternative to the browser plug-in, you can prevent Google Analytics from collecting your data by means of an opt-out cookie. To prevent Universal Analytics from collecting data across different devices, you must opt-out on all used systems. If you click on this link, the opt-out cookie will be set.

Please note that Google has its own data protection regulations, which are independent of ours.
